Max Swing Speed LLC (the “Seller”) offers its products to the purchaser (the “Purchaser”) with the following

terms, conditions and notices. Please review this information carefully. These terms and conditions include limited warranties and disclaimers of liabilities. Failure to heed to Disclaimer and Warnings may result in injury. Keeping, using, or allowing use of Seller’s products indicates Purchaser’s agreement to these terms. If Purchaser does not wish to agree to these terms, Purchaser has ten (10) days from the date of purchase to contact the seller to discuss options for the return of the unused product.

Warning

This product is not a toy.

Use on bats with 2-1/4” to 2-3/4” barrels.

Children under 12 use with adult supervision.

Inspect the product before each use to ensure it has not been damaged. If damaged, do

not use the product.

Do not hit a ball or other object with this product attached to the bat.

This product is not to be modified or altered in any manner. Any such modification or alteration may affect the integrity and safety of the product and could result in a greater risk of injury.

Do not use this product if it is not securely attached to bat or club.

Only use this product in an isolated, open area.

Do not permit any other person to use this product without ensuring that person has carefully read, understands and follows the instructions and recommendations contained here within.

Store indoors in a cool, dry place. Do not store in direct sunlight.

Assumption of Risk   

Use and misuse of products sold by Seller involves serious risks including injury, disability and death.

By buying, using, or allowing the use of Seller’s products, Purchaser understands and agrees that PURCHASER EXPRESSLY AND VOLUNTARILY ASSUMES THE RISK OF DEATH OR OTHER PERSONAL INJURY SUSTAINED WHILE USING THIS PRODUCT WHETHER OR NOT CAUSED BY THE NEGLIGENCE OR OTHER FAULT OF SELLER; including, but not limited to, equipment malfunction from use, misuse, or negligence, or any other fault of Seller. Additionally, Purchaser agrees to indemnify, defend and hold Seller harmless from any third party claims arising from equipment use, misuse, or malfunction.

Limited Replacement Warranty

The Seller warrants to the Purchaser the products will be free from defects in workmanship and materials and will conform to Seller’s specifications. Seller will replace this product if it is found to be defective. It is understood and agreed that Seller’s liability with respect to the products sold is restricted to replacement only. This warranty will continue for 30 days from the date of purchase of the Product.

Limitation of Liability

In no event shall Seller liability exceed the value of the product(s) sold. In no event shall Seller be liable for any direct, indirect, punitive, incidental, special or consequential damages whatsoever arising out of or connected with the use or misuse of any of its products.
